Competent decisions – the only way to achieve effective and sustainable work of local governments

On 1 February 2004, the Administrative Process Law (APL) entered into force.  It places strict requirements on every administrative act issued.  The study analyzed the administrative acts of five local governments to identify their adherence to the APL.  It sought answers to the following questions:  Are local government decisions of sufficient quality?  Can problems of incompetent decisions be quickly and easily resolved?  Is it possible that local governments will have to compensate individuals as a result of local government decisions?  How to decrease such a risk?

The study concluded that none of the administrative acts analyzed adhered to the requirements of the APL and put local governments at financial risk because they would have to provide compensation. The worst examples of such acts not adhering to the APL were issued by building councils. In comparison, the administrative acts of family and local courts were better prepared.

The study provides a vast source of information that will allow local governments to improve their administrative acts and their adherence to the APL. The study recommends that local governments change the process of preparing administrative acts and that legislators should revise the Law on Local Governments so that it conforms with the APL.
